What these terms cover
- These terms cover both the public website and the ViaVision iOS app unless a separate written customer agreement or regulated deployment notice says otherwise.
- ViaVision outputs may inform wellness, screening, engagement, or operational workflows, but they should not be treated as emergency, diagnostic, or treatment instructions unless expressly stated in product documentation.
- The current consumer app version is offered without a standalone user account or dedicated end-user backend, and subscriptions are handled through Apple App Store mechanisms and supporting subscription tooling.
Scope and acceptance
By accessing the website, downloading the iOS app, or using ViaVision features, you agree to these Terms of Use and to applicable laws governing your use of the service.
The current direct-to-consumer website and iOS app experience is operated by Individual Entrepreneur Ilia Egorov.
If you use ViaVision on behalf of a company, clinic, research organization, or other entity, you represent that you are authorized to bind that entity to these terms.
If a separate written agreement, order form, customer contract, data-processing agreement, business associate agreement, or regulated deployment notice applies to your use, that document controls to the extent of any conflict.
Eligibility and permitted use
You may browse the website, evaluate ViaVision, and use the iOS app only in a responsible manner that complies with these terms and any deployment-specific restrictions.
- Use the website and app only for lawful, authorized, and intended purposes.
- Follow all instructions, measurement requirements, eligibility rules, and safety information shown in the app or accompanying documentation.
- Do not interfere with service availability, security, accuracy workflows, or network integrity.
- Do not attempt unauthorized access, scraping, automated extraction, model probing, reverse engineering except where non-waivable law allows it, or misuse of any account, deployment, or data.
Intended use and medical disclaimer
Unless expressly stated in the App Store listing, product documentation, labeling, or a separate written agreement, ViaVision is provided for informational, wellness, screening, engagement, research, or operational-support purposes and is not intended to diagnose, cure, mitigate, treat, or prevent disease.
Website content, app outputs, and measurement results do not replace clinician judgment, regulated medical advice, or emergency services.
No emergency use and measurement limitations
Measurement quality can be affected by lighting, camera quality, device placement, motion, physiology, environmental conditions, and the way a user follows instructions.
You must not rely on ViaVision as the sole basis for emergency response, diagnosis, treatment, medication changes, or other high-consequence decisions unless your deployment is expressly validated and authorized for that use.
Your responsibilities
You are responsible for providing accurate information, using a compatible device, protecting device access, and using the website and app in compliance with privacy, employment, research, and healthcare rules that apply to you.
Do not upload or transmit patient records, third-party identifiers, credentials, or other sensitive data through public support or contact channels unless we explicitly designate that channel for secure submission.
App license and Apple platform terms
Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use the ViaVision iOS app on Apple-branded devices that you own or control, solely for your personal use or authorized internal business use and in accordance with Apple's usage rules.
Apple and its subsidiaries are third-party beneficiaries of the app-license terms applicable to the iOS app and may enforce those terms against you.
Restrictions
The website and app may not be used in ways that violate law, third-party rights, product documentation, or deployment restrictions.
- Copy, distribute, rent, sublicense, resell, or commercially exploit the website or app except as expressly authorized.
- Bypass technical controls, security features, consent mechanisms, or access restrictions.
- Use the service to create unlawful surveillance, deceptive health claims, discriminatory profiling, or prohibited regulatory or clinical workflows.
- Upload malicious code, interfere with APIs, or attempt to extract source code, models, or confidential business information.
Paid features and customer deployments
The current consumer app version may offer paid features or auto-renewable subscriptions through the Apple App Store. Pricing, billing, renewal, cancellation, and refund terms shown in the App Store flow, in-app purchase screen, or Apple's platform terms will apply to those purchases.
RevenueCat may be used to support subscription status, entitlement handling, and related app monetization workflows for App Store purchases.
If you access ViaVision through a business customer, clinic, insurer, employer, or partner, that organization may control which features are available to you and may impose additional program terms.
Intellectual property and feedback
The website, app, brand elements, measurement workflows, content, software, models, visual assets, documentation, and related intellectual property are owned by ViaVision or its licensors and are protected by applicable law.
If you provide feedback, suggestions, or product ideas, you grant us the right to use them without restriction or compensation unless non-waivable law says otherwise.
Availability, suspension, and termination
We may update, suspend, limit, or discontinue all or part of the website or app at any time, including to address safety, quality, legal, customer, or business requirements.
We may suspend or terminate access if we reasonably believe your use violates these terms, threatens security, creates legal risk, or conflicts with a customer deployment or regulatory requirement.
Disclaimers and limitation of liability
To the maximum extent permitted by law, the website and app are provided on an "as is" and "as available" basis, without warranties of availability, uninterrupted operation, accuracy, merchantability, fitness for a particular purpose, or non-infringement.
To the maximum extent permitted by law, ViaVision and its affiliates, licensors, and service providers are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, or data arising out of or related to your use of the website or app.
Nothing in these terms excludes liability that cannot be excluded under applicable law.
Changes and contact
We may update these Terms of Use from time to time by posting a revised version on this page. Continued use after the updated date means you accept the revised terms, subject to any rights you have under applicable law.
