What these terms cover

  • They apply to the website, the console, the documentation, the SDKs, and the cloud API, unless a separate signed agreement covers your use.
  • Neccessory produces wellness estimates from a camera signal. It is not a medical device and must not be used for diagnosis, treatment, or emergency decisions.
  • If you integrate Neccessory into your own product, you are responsible for consent, for your own privacy notice, and for how results are presented to your users.
  • Cloud measurements are paid from a prepaid token balance; refunds are governed by the Refund Policy.
1.

Scope and acceptance

By using the website, creating a console account, downloading or integrating an SDK, or calling the API, you agree to these terms.

Neccessory is operated by Individual Entrepreneur Ilia Egorov.

If you act on behalf of a company or another organization, you confirm that you are authorized to bind it to these terms, and the organization is bound by them.

If a separate written agreement, order form, or data processing agreement applies to your use, that document controls to the extent of any conflict.

2.

Accounts, organizations, and API keys

Using the API requires a console account. An organization is created for you on first authorized use, and the account that created it holds the owner role.

API keys authenticate your integration.

  • You are responsible for everything done with your account and your keys, including by your employees, contractors, and applications.
  • A key secret is shown once, at creation. We store only its hash and cannot show or recover it; a lost secret is replaced by rotating the key.
  • Keep live and test keys separate, keep secrets out of client-side code and version control, and rotate a key immediately if it may have been exposed.
  • Tell us without delay if you suspect unauthorized use of your account, your keys, or your organization's balance.
  • On-device model weights are released only to organizations we have approved for that tier, and only for the platforms named in the approval.
3.

Eligibility and permitted use

Access is granted for evaluation and for integration into your own products, subject to these terms.

  • Use the website, the console, the SDKs, and the API only for lawful purposes and in the way the documentation describes.
  • Follow the measurement requirements, eligibility rules, and safety information published in the documentation.
  • Do not interfere with availability, security, or integrity, and do not attempt unauthorized access to another organization's data.
  • Do not scrape, automate, or probe the service beyond what the documented API allows.
4.

Intended use and medical disclaimer

Neccessory is provided for wellness, informational, screening, research, and operational-support purposes. It is not intended to diagnose, cure, mitigate, treat, or prevent any disease, and it is not a medical device unless a separate written agreement and the applicable regulatory clearance say otherwise.

Results do not replace clinician judgment, regulated medical advice, or emergency services.

Blood pressure, SpO2, emotion, and gaze outputs are published as beta. They are less reliable than heart rate, HRV, and breathing rate, may change between releases, and must be labeled as estimates wherever you show them.

No emergency use and measurement limitations

Measurement quality depends on lighting, camera quality, device placement, motion, physiology, environment, and how closely the person follows the instructions. A measurement can fail or return a low-quality result, and the documented limits are part of the product, not a defect.

Do not rely on Neccessory as the sole basis for emergency response, diagnosis, treatment, medication changes, insurance decisions, employment decisions, or any other high-consequence decision.

Your obligations as an integrator

If you integrate Neccessory into a product of your own, you are the controller of your users' data and the following are your obligations.

  • Obtain valid, informed, specific consent from every person you measure, be able to evidence it, and assert it truthfully in the API call that requires it.
  • Publish your own privacy notice. If you ship the cloud tier, it cannot say that processing is local: say that face images are transmitted to a processor, name the purpose, and say that the metrics are retained and the images are not.
  • Hold the rights necessary to send us any video or frames you upload.
  • Check data-localization requirements before you integrate the cloud tier, and talk to us first where they apply.
  • Present results as wellness estimates, make no medical claims we have not agreed in writing, and keep the disclaimer visible to your end users.
7.

SDK and API license

Subject to these terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to integrate the web and iOS SDKs into your own applications and to use the API for the duration of your access.

You may not reverse engineer, decompile, or disassemble the SDKs or the measurement engine, extract or redistribute model weights, or circumvent the model key, entitlement, or signing mechanisms, except to the extent that non-waivable law expressly allows it.

Redistributing the SDK to third parties, embedding it in a product you resell as a measurement toolkit, or making it available through your own API requires a separate written agreement.

If you distribute an application through a platform store, complying with that platform's rules and review requirements is your responsibility.

8.

Restrictions

You may not:

  • Resell, sublicense, or proxy the API for third parties without a written agreement.
  • Extract, copy, or reconstruct the models, or use outputs to train a competing measurement model.
  • Circumvent quotas, rate limits, request signing, test mode, or billing.
  • Use the service for covert surveillance, deceptive health claims, discriminatory profiling, or monitoring of people who have not consented.
  • Upload malicious code, interfere with the service, or attempt to access data belonging to another organization.
9.

Tokens, pricing, and payment

Cloud measurements are paid for in tokens drawn from your organization's prepaid balance.

We may change prices, packs, and the token cost of a metric set with reasonable notice. Tokens already credited keep the value at which they were credited.

Refunds are governed by the Refund Policy published on this site.

  • A completed cloud job is charged for the seconds it processed plus a fixed price for each metric set it requested. Jobs that fail, are aborted, or expire are not charged. Test keys and the on-device tier are free.
  • The live pricing configuration is published by the API and takes precedence over any figure quoted elsewhere, including in the documentation. The reference rate is one US dollar to one hundred thousand tokens.
  • New organizations receive a welcome grant. Grants and promotional credits have no monetary value and are not exchangeable for money.
  • The balance check when a measurement starts is an estimate. A running measurement is never cut off, so a final charge may take the balance slightly below zero; the next measurement is blocked instead.
  • Per-key monthly caps are available in the console so that one integration cannot spend the whole balance.
  • Packs are paid for by card in the console through our payment provider. Tokens are credited to the organization's balance once the provider confirms the payment, and the credit appears in the ledger like any other entry.
10.

Availability and changes to the service

We do not commit to a specific level of availability unless a signed agreement says otherwise. The service may be unavailable during maintenance, incidents, or provider outages.

We may add, change, deprecate, or withdraw parts of the API, the SDKs, and the console. For changes that break a documented interface we give reasonable notice through the documentation, the console, or by email. Features marked beta may change or be withdrawn at any time.

11.

Suspension and termination

We may suspend or terminate access if you breach these terms, if your use threatens the security or integrity of the service, if amounts owed to us remain unpaid, or if the law requires it. Where circumstances allow, we give notice and an opportunity to fix the problem first.

You may stop using the service and close your organization at any time from the console.

On termination, keys stop working and access to the console ends. Data is deleted or anonymized as described in the Privacy Policy, and any unused balance is handled under the Refund Policy. Export what you need before you close the account.

12.

Intellectual property and feedback

The service, the SDKs, the models, the documentation, the brand, and all related intellectual property belong to Neccessory or its licensors. These terms grant access, not ownership.

Measurement results produced for your organization belong to you, and you grant us only the rights needed to operate the service, produce the results, and meet our legal obligations.

If you send us feedback or product ideas, we may use them without restriction or compensation, unless non-waivable law says otherwise.

13.

Disclaimers and limitation of liability

To the maximum extent permitted by law, the service is provided on an "as is" and "as available" basis, without warranties of availability, uninterrupted operation, accuracy of measurement outputs, merchantability, fitness for a particular purpose, or non-infringement.

To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, business, goodwill, or data arising out of or related to your use of the service.

To the maximum extent permitted by law, our total liability for all claims arising in any twelve-month period is limited to the amounts you paid us for the service during that period.

Nothing in these terms excludes liability that cannot be excluded under applicable law, including liability for death or personal injury caused by negligence and for fraud.

14.

Changes and contact

We may update these terms by publishing a revised version on this page. Continued use after the updated date means you accept the revision; material changes affecting paying customers are communicated through the console or by email.
